Judgement

R. D. MUHAMMAD, J.C.A. (Delivering the Leading Judgment): This is an appeal from the decision of the Local Government Election Tribunal sitting at Sokoto. On the 5th day of December, 1998 elections were held nationwide for the Chairmanship of all the Local Government Councils in the country. Aliyu Shedu Achida contested the Chairmanship of the Wuro Local Government Council under the umbrella of the people's Democratice Party (PDP) while Mohammed Dan Ango contested under the umbrella of the all People's Party (APP). At the end of the election Mohamed Dan Ago was declared the winner.

Aggrieved, Aliyu Shedu Achid a presented a petition at the Election Tribunal, Sokoto challenging the declaration and the return of Mohammed Dan Ango as duly elected on the ground that he was not qualified to contest the said election by reason of not having paid tax for 1995, 1996 and 1997 at all or as at when due.
