Judgement

A. M. MUKHTAR, J.S.C. (Delivering the Leading Judgment): In the High Court of Kebbi State, the appellant together with five other accused persons pleaded not guilty to the charges of Criminal Conspiracy contrary to section 97 of the Penal Code, Abatement contrary to section 85 of the Penal Code, Culpable homicide punishable with death contrary to section 221(a) of the Penal Code. The appellant as the 6th accused was alleged to have conspired with his co-accused persons to kill one Abdullahi Alhaji Umaru. The case for the prosecution is that the appellant, together with some others went to confirm the appellant on receiving the information that someone had abused the Holy Prophet Mohammed, together with some others went to confirm the truthfulness of the information, and on the confirmation of the story, they caused the death of the deceased by slaughtering him with a knife.
