UMOREN JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Federal High Court sitting at Kaduna, refusing appellant’s application to set aside the judgment of the Failed Banks (Recovery of debts) and Financial malpractices in Bank Tribunal, Kano zone (Failed Banks Tribunal), delivered 24th April, 1998. The action in the Failed Bank Tribunal was brought on the undefended list for the sum of N969,572.01 on 1st April, 1998. Judgment was as stated above, delivered on 24-4-1998, in favour of applicant now respondent. Dissatisfied with the decision of the Failed Banks Tribunal, the respondent, now appellant, filed an application on 22-10-99 in the Federal High Court to set aside the judgment of the Failed Banks Tribunal. On 7-3-2000, the Federal

High Court delivered a considered ruling dismissing the applicant’s application. Dissatisfied still, the applicant/appellant brought this appeal on two grounds of appeal which without particulars are as follows:
