PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): This cross appeal is against Part of the decision of the BAYELSA STATE NATIONAL AND STATE HOUSES OF ASSEMBLY ELECTION PETITION TRIBUNAL Which sat on 21st September, 2019 which held among other;

(a) That Exhibits P6, P8, P10, P14, P19, P21, P23, P25, P29, P31, P33, P35, P43, P46, P48, P50, P52 and P54 (Voters Registers) tendered by the Cross Appellant are inadmissible.

(b) That Petitioners did not specifically plead FORM EC 258 and did not also pay the stipulated fees for obtaining the certified True Copies of Forms EC25B (Material Distribution forms). Yet the said Tribunal failed to out-rightly reject the said document as inadmissible in the Proceedings.

The All Progressives Congress the Cross Appellant herein filed the said Cross appeal on 11th October, 2019 and it consists of three grounds which without their particulars are as follows:
