CHINWE EUGENIA IYIZOBA, J.C.A.(Delivering the Leading Judgment): This is an appeal against the Ruling of the Federal High Court Ibadan Judicial Division in Suit No. FHC/IB/CS/101/2014 delivered on the 4th day of October, 2017 Coram Ayo-Emmanuel J. dismissing the Appellants application.
THE FACTS: The Appellant whose office is at Abuja is the 2nd Defendant in the suit filed by the 1st Respondent at the Federal High Court, Ibadan, Oyo State. A primary Election was conducted by the Appellant at which the 1st and 2nd Respondents vied for the position of the party candidate for the House of Representatives Oluyole Federal Constituency Ibadan, Oyo State. At the conclusion of the primaries, the 2nd Respondent was declared the winner and thus the flag bearer of the Appellant to contest the seat.
