ADAMU JAURO, J.C.A. (Delivering the Leading Judgment): The appeal herein is against the judgment of the Plateau State High Court of Justice, delivered by Hon. Justice D. G. Mann on 21st February, 2014 in Suit No. PLD/J476/2013.

The facts culminating in this appeal can be summarized as follows: The 1st Respondent, Plateau State Independent Electoral Commission issued a notice for the conduct of Local Government Elections in Plateau State. The notice was issued on 2nd September, 2013 for the elections to be conducted on 7th December, 2013 though the date was subsequently adjusted to 21st December, 2013. Upon the issuance of the Notice and the Guidelines for the Local Government Election 2013, the All Progressives Congress (Appellant as Plaintiff) filed an Originating Summons against the 1st to 3rd Respondents as Defendants on 17th October, 2013.
