AR SECURITY SOLUTIONS LTD V. ECONOMIC AND FINANCIAL CRIMES COMMISSION (EFCC)

MOHAMMED MUSTAPHA, JCA (DELIVERING THE LEADING JUDGMENT): This appeal is against the Ruling of the Federal High Court, sitting in Abuja; Coram Hon. Justice B.F.M. Nyako, delivered on the 22nd day of April, 2016.

The Applicant (now the Respondent), had by an Exparte Originating Summon, dated 21st day of December, 2015: sought for the following relief at the trial Court:

1. An Order of this Honorable Court granting the Chairman of the Commission or any officer authorized by him power to instruct a bank examiner to issue an order as specified in Forms B of the Schedule to the EFCC Act 2004 to Bank Managers of banks or any person having control of the banks where the accounts are to be frozen, the accounts shown in the schedule hereunder for six (6) months.

2. An Order of this Honourable Court granting power to the Chairman of the Commission or any officer authorized by him to direct the banks shown in the schedule to supply any information and to produce opening documents to the account and…
