CHIDI NWAOMA UWA, J.C.A. (Delivering the Leading Judgment): The appeal is against the judgment of the Kwara State High Court delivered on 26th September, 2016, presided over by M.A. Folayan, J, in which the trial Court dismissed the claim and the counter claim of the appellant as the claimant and the respondents as the defendants/counter claimants. The Appellant was dissatisfied with the decision of the trial Court, thus this appeal. The appellants claim at the lower Court is as contained in his Amended Writ of Summons and Amended Statement of Claim both dated and filed on 6th March, 2015.
