Judgement

JUDGMENT 

Plaintiff issued this Writ against the Defendants for the following reliefs: 

a. An order for declaration of title to the land in favour of Plaintiff.

b. A declaration that 1st Defendant has trespass unto Plaintiffs land.

c. An order against 1st Defendant to remove all the structures on the Plaintiffs land put there by 1st Defendant. 

d. An order for damages for trespass against 1st Defendant.  

e. Costs. 

Plaintiff said he noticed 1st Defendant trespassed onto his land, cleared same and  placed a forty-footer container which was roofed and under lock and key; after 1st Defendant undertook some renovation exercise without Plaintiff’s consent. Plaintiff  said after the renovation 1st Defendant handed over the keys to 2nd Defendant who 1st Defendant claims is the owner of the land in dispute. Plaintiff said he contacted 2nd Defendant who refused to hand over the keys to the container claiming ownership of  the land. Plaintiff says 1st Defendant has trespassed on his land and has c…
