Judgement

(DELIVERED BY JAMES SHEHU ABIRIYI, J.C.A.) This appeal is against the ruling delivered on 15th December, 2016, in the Federal High Court, Taraba Judicial Division sitting at Jalingo in a Fundamental Rights matter wherein the Respondent was the Applicant and the Appellant the Respondent.

The Respondent prayed for seven weird orders contained at pages 1 and 2 as well as page 15 – 17 of the record of appeal. The grounds upon which the application was brought equally weird are various Sections of the 1999 Constitution FRN (as amended) and various Articles of the African Charter on Human and Peoples Rights. The provisions of the Constitution alleged to be the grounds for the application are Sections 34(1) (a), 35, 36(1), 40 and 43 of the Constitution while the Articles of the African Charter on Human and Peoples Rights alleged to be also grounds for the application include Articles 5, 7(1), 10(1) and 14.

The application of the Respondent was supported by an affidavit and several Exhibits. …
