C. F. Chukwuneke For Appellant C. H. Azuine (Mrs) For Respondent

Judgement

Parties absent.

Mr. Chukwuneke: - Argues his motion filed on 5th November, 2008 seeking the trinity prayers. The motion is supported by an 11 paragraph affidavit. We rely on all the paragraphs. We urge the Court to grant and prayer.

Mrs. Azuine: - Replies and says we urge the Court not to grant the application.

RAPHAEL CHIKWE AGBO, J.C.A.(Delivering the Lead Ruling): The reasons proffered by the applicant to ground this application are not cogent enough. More importantly the proposed grounds of appeal cannot even if argued uproot the judgment of the trial Court. This application is dismissed.

AYOBODE OLUJIMI LOKULO-SODIPE, J.C.A.: I agree.

ITA GEORGE MBABA, J.C.A.: I agree.
