Judgement

MUKHTAR, JCA (Delivering the Lead Judgment): The appellants, who were not parties to suit No. PLD/LF.13/93 before the High Court of Plateau State holden at Lafia sought to be joined as co-defendants, but their application was refused. The reliefs sought by the plaintiffs as per the ruling of the lower court are as follows:-

(1) A declaration that in accordance with age-long tradition, native law and custom, the usages and unwritten constitution of the Obi Community, the title of the Chief is β€œThe Osuko of Obi.”

(2) A declaration that the Chief of Obi as Osagye of Obi has never been known to the age-long tradition, native law, custom, the usages and the unwritten constitution of the Obi Community.

(3) A declaration that by virtue of their native law and custom , the eligibility to the stool of the Osuko of Obi is only open to the male descendants of the Royal Families in Obi alone.

(4) A perpetual injunction restraining the defendants, their agents, privies or howsoever otherwise named …
