This appeal is about Emmanuel Adotey Akueson (deceased) who was Plaintiff/Respondent’s father-in-law and with whom Respondent entered into an agreement to build twelve stores, six on each floor on his property situate at Abossey Okai. The twelve stores on completion were to be shared equally between the Plaintiff and the late Emmanuel Adotey Akueson.

Based on that understanding, the Plaintiff demolished the old building and started the construction of the Block of twelve permanent stores. Six (6) stores on the ground floor were completed by the Plaintiff and rented out to tenants for ten years at a total rent of GH¢18,000.00 and paid to the late Emmanuel Adotey Akueson. Unfortunately, before the agreement between them could be reduced into writing, the said Emmanuel Adotey Akueson died.
