RIDWAN MAIWADA ABDULLAHI, J.C.A. (Delivering the Leading judgment): The Appellant as 1st accused person was arraigned before the High Court of Ondo State sitting at Akure on 13th December, 2012 vide an Amended Information for the following offence:

STATEMENT OF OFFENCE

RECEIVING STOLEN PROPERTY, contrary to and punishable under Section 5 of Robbery and Firearms (Special Provisions) Act, Cap R11, Laws of the Federation of Nigeria.

PARTICULARS OF OFFENCE

ADIJAT AYEFIGBO (F) on or about 12th day of November, 2011 at Owo, in the Owo Judicial division did receive and keep in your custody a stolen Nokia Cell Phone property of Dr. Obawoyen Ademola and knowing it to have been stolen.

Upon arraignment, the Appellant pleaded not guilty and the case went to trial. The prosecution called 3 witnesses and tendered 9 exhibits. The Appellant testified for herself and called no other witness.
