Judgement

OBADINA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the Kwara State High Court sitting at Ilorin, dated 10th July, 1998. The appellant was the plaintiff before the High Court and the respondent was the defendant. The appellant is a quantity surveyor of repute and who, according to the amended statement of claim, had been consulted by various firms, institutions, Government and Government agencies in Nigeria and Overseas countries. The respondent appointed the appellant as a consultant in respect of the respondent's building project, namely, the construction of the building of the Faculty of Law within the respondent's premises at Ilorin. By this appointment the appellant was to prepare Bills of Quantities, prepare Tenders Report and Guide the respondent at its Tenders Board Meetings.
