ABIMBOLA OSARUGUE OBASEKI-ADEJUMO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Lagos State High Court delivered on the 9th of October, 2015; coram OKUWOBI J., wherein the learned trial judge dismissed the Appellants suit on the ground that the claims are unproven. The Appellant commenced the suit at the Lower Court to challenge the nomination and selection of the 1st Respondent as the Baale - Elect of Obadore in Alimosho local government area of Lagos State, which he claimed to be in flagrant conflict with the provisions of the registered chieftaincy declaration of the Lagos State government official gazette No.4 volume 29 of 4th March, 1996 regulating succession to the stool. The Appellant been dissatisfied with the judgment appealed to this Court vide a Notice of Appeal based on six grounds and filed 13th October, 2015.
