Judgement

AMAIZU JCA (Delivering the Lead Judgment): The appellant herein was the defendant in suit A/188/2001 presided over by Okoh J., of the Delta State High Court, sitting at the Asaba Judicial Division of the court.

In that suit, the respondent herein as plaintiff, sued the appellant claiming declaratory and injunctive reliefs.

The respondent also filed an ex parte motion praying the court for:-

β€œAn order of interim injunction restraining the defendant from travelling out of this country and/or place, pending the determination of the motion on notice.

(b) An interim order directing the sheriff of this Honourable Court to take possession of the international passport and other tr avelling documents of the d efen dan t, p ending the determination of the motion on notice.
