YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Lead Judgment): This appeal is against the ruling of the Federal High Court, sitting in Lagos State and delivered by HONOURABLE JUSTICE M.B. IDRIS on the 11th of December, 2017 in Suit FHC/L/CS/1554/2016. The Court below found that the Appellant’s action was statute barred and dismissed the suit.
Dissatisfied with the decision of the Court below, the Appellant filed a Notice of Appeal on the 7th of March 2018, setting out 5 grounds of appeal. The facts leading to this appeal are amenable to a brief summary.
