Judgement

JUMMAI HANNATU SANKEY, J.C.A. (Delivering the Lead Ruling): This Appeal is predicated on the Judgment of the High Court of Nasarawa State in Suit No. NSD/K25/2000 delivered by Dikko, CJ on 4th August, 2004. Therein, Judgment was given in favour of the Plaintiff and the Respondents' counter-claim was dismissed.

Dissatisfied, the Defendants, (now Appellants), filed their Notice of Appeal on 21st September, 2004 wherein they complained on four grounds. Thereafter, this Court granted the Appellants leave to file three additional grounds of appeal on 28-04-15 in terms of the Exhibit B annexed to the Motion on Notice dated 07-12-12 and filed on 10-12-12. Clean copies of the Amended Notice filed on 28-04-15 are contained in the Court File. By the same motion, leave of Court was sought and obtained to compile, transmit and serve the Record of Appeal on the same date.

Following three (3) separate motions ex parte filed by the Appellants on 25-03-13, 17-06-14 and 30-09-15, this Court granted ordeā€¦
