TUR JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Hon. Justice Ibrahim M. Bako, sitting at the High Court of Justice, Funtua, in Katsina State, dismissing the claims of the plaintiff (now appellant) against the defendant/respondent to the land lying and situate at Kofar Fada Bakori, ordinarily known and called “Gidan Kwaimo.” The land is covered by a Certificate of Occupancy No. KT. 11948 issued on 16 November 2005, in favour of the plaintiff/appellant. The judgment was delivered on 28January 2009. The noticeof appeal filed on 2 February 2009 contains eight grounds of appeal. Learned counsel to the appellant formulated five issues and the learned counsel to the respondent identified four for determination in the brief filed on 23 October 2009.
