KEKERE-EKUN JCA (Delivering the Lead Judgment): This is anappeal against a ruling delivered by the Kaduna State High Court on 4th August, 1999 in suit No. KDH/Z/33M/98 refusing an application by the appellants for an order of certiorari or prohibition to quash the proceedings of the Upper Area Court, Tudun Wada, Zaria instituted against them by the 1st respondent. The 1st respondent as plaintiff before the Upper Area Court Tudun Wada, Zaria by a motion on notice dated 26/2/98 applied for the issuance of a writ of summons against the appellants as defendants seeking the following reliefs: “(a) A declaration that the enticement by the 1st and 2nd defendants of the plaintiff’s wife is illegal and contrary to native law and custom.
