OBANDE FESTUS OGBUINYA, JCA (Delivering the Leading Judgment): This appeal queries the correctness of the decision of the High Court of Kano State, holden at Kano (hereinafter addressed as “the lower court”), coram judice: NuraSagir Umar, J., in Suit No. K/465/2000, delivered on 19th July, 2015. Before the lower court, the appellant, the first and second respondents and third respondent were the judgment/creditor/applicant garnishee, the judgment debtors and garnishee respectively.

The facts of the case, which transformed into the appeal, are amenable to brevity and simplicity. On 5th July, 2002, the appellant obtained judgment against the first and second respondents in the sum of N17, 189, 018.89 (Seventeen Million, One Hundred and Eighty-Nine Thousand, Eighteen Naira, Eighty-Nine Kobo) from the High Court of Kano State.
