ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): Appellant filed this appeal against the judgment of National Industrial Court of Nigeria in Suit No. NICN/KN/13/2017 delivered on 6/7/2017 by Hon. Justice Lawal Mani (Ph.D.) wherein the learned trial Court granted the reliefs sought by plaintiff and reinstated the plaintiff to his office.
At the lower Court, the Respondent, as plaintiff, had sought, by way of originating summons, answers to the following questions:
(1) Whether by virtue of express provisions of Section 16 of Bayero University Act, Section P of the Senior Staff Service Conditions and Regulations of Bayero University, Kano and the judgment of this Court in Suit No. NICN/KN/16/2012, the claimant’s appointment can be terminated on the ground that the claimant’s service are no longer required by the defendant.
