JUDGMENT 

Applicant sought by motion on notice interlocutory injunction restraining  Respondent from setting aside Applicant from office pursuant to Order 25 rule 1  of High Court (Civil Procedure) Rules 2004 (CI 47). The affidavit in support  indicates that Applicant is the Chairman of the unionised staff of Bulk Oil Storage  and Transportation Company Limited otherwise known as BOST. He was elected  to the office on 5th March 2013 for a four year term. The BOST union is affiliated  to or a division of Respondent and for that matter governed by Respondent’s  constitution adopted 14th March 2012 and attached as exhibit BO1. Pursuant to article 10 clause b thereof, the National Executive Council of Respondent is  composed of inter alia one representative from each division with a total  membership of not less than 2 and not more than 300.
