Judgement

EKPE, JCA (Delivering the Lead Judgment): This appeal by the appellants is against the Order of Bench Warrant made by Nwaogwugwu, J. in suit No. FHC/AK/M28/98 at the Federal High Court, Calabar on 17th of February, 1999. The background facts leading to this appeal are of a considerable length and interwoven. However, as gleaned from the records of the appeal the facts may be summarised thus: 2nd appellant is the Managing Director of the 1st appellant, a limited liability Company, engaged in the business of importation and sale of frozen fish. One Sab Allied Ventures Ltd. also a limited liability Company at all material times prior to this case had maintained cordial business relationship with the 1st appellant by purchasing and selling the 1st appellants’ imported frozen fish. The respondents are the Managing Director and Manager respectively of the said Sab Allied Ventures Ltd.
