MOHAMMED LAWAL GARBA, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal sitting in Sokoto Judicial Division delivered on the 25th day of January 2019 where the lower court dismissed the appeal and affirmed the judgment of the Kebbi State Shariah Court of Appeal delivered on the 2nd day of May, 2017. Dissatisfied with the decision of the lower court, the appellant appealed to this court on three grounds as contained in the notice of appeal filed on the 4th day of March 2019.
To argue the appeal, the appellant’s brief of argument was filed on the 1st day of June 2022 and settled by Mohammed Adelodun Esq.The brief was deemed properly filed on the 8th day of October 2025.
