Judgement

OBADINA, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Taraba State High Court sitting at Jalingo delivered on the 22nd day of February, 1996. The respondent was the plaintiff, while the appellant was the defendant at the trial court. In paragraph 6 of the further amended statement of claim, the respondent claimed against the appellant, for the following reliefs:- “(a) N117,995.00 as special damages being incurred as a result of injuries sustained due to the defendant’s negligence drive.

(b) An order compelling the defendant to pay all additional medical bills and/or any other expenses that would be incurred in the course of treatment from the date of filing this suit until judgment is delivered in the matter. (c) N5,000,000.00 as general damages.”

Pleadings were filed and exchanged by the parties. At the trial, the plaintiff/respondent testified and called three other witnesses, while the defendant/appellant gave evidence in his own defence but called …
