Judgement

AMAIZU JCA (Delivering the Lead Judgment): In this suit, which was commenced in Sapele Judicial Division of the Delta State High Court, the plaintiff, a limited liability company incorporated in Nigeria, claimed against the defendants, jointly and severally as follows:

“(1) The sum ofN100,000,000.00 (one hundred million naira), being special and general damages by themselves and their servants, and agents, who negligently and completely destroyed by fire the plaintiff’s hotel buildingtogether withall itscontents, situate at Koko beach, Koko, in Warri North LocalGovernment Area , of Delta State, within the jurisdiction of this honourable court.

(2) The plaintiff further claims 121/ %compound interest per month 2 on the said N106,200.00 (One hundred and six thousand, two hundred naira), until the determination of this suit and thereafter 10% compound interest per month on the said amount until payment is complete”.
