NGWUTA JSC (DELIVERING THE LEADING JUDGMENT):Ā The appellant herein commenced an action by way of a writ of summons issued at the registry of the Federal High Court, Lagos Judicial Division, on 12 December 2013, claiming declaratory and other reliefs against the respondents, then defendants. In view of the time element in the interim injunction, the subject of this appeal, I will set out the processes filed with reference to the dates of filing.
On 12 December 2013, the appellant as plaintiff commenced the actionĀ viaĀ writ of summons. On the same day, he filed other processes by including a motionĀ ex parteĀ for an interim injunction pending the hearing of the motion on notice for interlocutory injunction.
On 13 December 2013, the trial court heard and granted the motionĀ ex parteĀ for an interim injunction. The motion on notice for interlocutory injunction was fixed for hearing on 27 January 2014. On 18 December 2013, the appellant filed another motionĀ ex parteĀ for an order to correct errorā¦
