BUA INTERNATIONAL LIMITED V. MEDITERRANEAN SHIPPING CO. NIG. LTD & ANOR

TIJJANI ABUBAKAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the Ruling of the High Court of Lagos State delivered on the 30th day of June 2014, by DADA J, in suit No. LD/2271/2011 striking out Appellants objection to the jurisdiction of the trial Court. The Ruling subject matter of this appeal is found at pages 1- 4 of the records appeal.

Just by way of brief summary of facts giving rise to this appeal. The Appellant herein was sued before the Lagos High Court by the 1st Respondent along with the 2nd Respondent, and in the said suit, the 1st Respondent claimed as follows:

1. The return of all the Claimant's containers unlawfully detained by the Defendants or the payment of their replacement value of USD 226,270.69 or its Naira equivalent of N35,062,643 at the rate of N155 to 1 USD.

2. The sum of N44,560,250 (Forty-four Million, five hundred and sixty thousand two hundred and fifty naira) being the unpaid demurrage that had accrued in respect of 12 of the claimant's…
