CAT CONSTRUCTION GROUP LTD V. UACN PROPERTY DEVELOPMENT CO. PLC & UPDC HOTELS LIMITED

BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of Lagos State, Ikeja Judicial Division, Coram: F. Bankole-Oki J, in Suit No. M/182/2009: CAT Construction Group Limited V. UACN Property Development Co. Plc & Ors delivered on 23/3/2018, in which some of the claims of the Respondents/Counter - Claimants against the Appellant as Defendant to Counter - Claim was granted. 

The Appellant was peeved with the said judgment and had appealed against it vide his Notice of Appeal filed on 27/3/2018 on nine Grounds of Appeal. See pp 175 - 181 of the Record of Appeal. The Record of Appeal was compiled and transmitted to this Court on 16/7/2018. A subsequent Notice of Appeal was filed on 21/6/2018 on twelve Grounds of Appeal. See pp 182 - 191 of the Record of Appeal. The Parties filed and exchanged their briefs, namely: The Appellant’s brief, the Respondents’ brief and the Appellant’s Reply brief.
