(Delivering the Leading Judgment).This is an appeal against the ruling of the Kano State High Court of Justice (the lower Court) in suit No. K/M319/2016 delivered on the 27th of April, 2017. The background facts leading to the filing of the Notice of appeal against the ruling of the lower Court to this Court are simple and straightforward. The respondent (as plaintiff) in suit K/M22/2013, obtained judgment at the High Court of Justice, Kano State against the Commissioner of Police, Kano State, in the sum of One Million Naira (1,000,000.00). To satisfy the judgment debt, the respondent initiated a garnishee proceedings against the Commissioner of Police, Kano State, seeking to attach sums of money in custody of the Central Bank of Nigeria, the appellant.
