SAULAWA, J.S.C. (Delivering the Leading Judgment): The present appeal is consequent upon the judgment of the Court of Appeal, Ibadan Judicial Division, delivered on November 30, 2012, in appeal No. СА/1/21З/2010. In the decision in question, the court below, соrаm—М.В. Dongban-mensem, C.N. Uwa, and J.S. Ikyegh, JJ.CA, allowed the respondent’s appeal, set aside the ruling of the trial court, and struck out the suit (НСТ/З20/2007) on account of incompetence, arising from lack of proof of the juristic existence of the sole defendant sued in the action.

Dissatisfied with the decision of the court below, the appellants filed the instant appeal, thereby urging the court for the following reliefs:

(а) An order allowing the appeal and setting aside the judgment of the Court of Appeal striking out the suit.

(b) An order upholding the ruling of the High Court of Ogun State (per Onamade J.) delivered on the 10th of July 2008 dismissing the defendant’s application.
