<p><strong>ABUBAKAR DATTI YAHAYA, JCA (Delivering The Leading Judgement)</strong>: This is an appeal against the decision of the High Court of Niger State holden at Kontagora, in suit number NSHC/KG/14/2014 delivered on the 16th December, 2014 by Hon. Justice Yusuf T. Usman wherein it was held as follows;</p><ol><li>The appellant alongside the 3rd and 4th respondents are bound to the 1st and 2nd respondents under the lease agreement dated 31st August, 2013.</li><li>The appellant alongside the 3rd and 4th respondents breached the said lease agreement when the cheque issued by the 3rd and 4th respondents to the 1st and 2nd respondents was returned unpaid by the bank.</li><li>The equipment in contention be released to the 1st and 2nd respondents from the custody of the appellant.</li><li>The appellant alongside the 3rd and 4th respondents are to pay the 1st and 2nd respondents the sum of N10,000,000.00 same being the outstanding payment on the lease of the equipment.</li><li>The appellant alongside the 3rd and 4th respondents are to pay the 1st and 2nd r…</li></ol>
