Judgement

ABIMBOLA OSARUGUE OBASEKI-ADEJUMO, J.C.A. (Delivering the Leading Judgment): On 11th November, 2016, the High Court of Lagos State, coram IPAYE, J, (Mrs.) refused the Appellant's Application dated 24th October, 2016 praying for the order of Court admitting him to bail pending trial. The Ruling of the trial Court can be found at pages 245 to 250 of the record of appeal.

Aggrieved with the said Ruling, the Appellant filed the present appeal predicated on the Amended Notice of Appeal dated 23rd January, 2017 and in compliance with the rules of the Court, an Appellant's brief of Argument dated 4th April, 2017 was filed on the same day. Therein, a sole issue was formulated thus:

"Whether in the special circumstances of this case the appellant is entitled to be admitted to bail pending trial.

Or put in another way

Whether in refusing to admit the appellant to bail, the learned trial judge of the Court below exercised her discretion Judiciously and judicially or exercised it arbitrarily."
