OGUNWUMIJU JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the National and State Houses of Assembly Election Tribunal, Enugu delivered on 26 August 2015 in Chukwudi and Anor. v. Ude-Okoye and 2 Ors. (EPT/ENU/ HA/17/2015 in which the tribunal dismissed the petition.
The facts which led to this appeal are as follows:-
The 1st appellant herein was a candidate at the election for the Enugu Sta te House of Assembly for Awgu North Constituency held on 11 April 2015. The 2nd appellant was the party that nominated him. The 1st respondent as candidate of the 2nd respondent was returned as winner by the 3rd respondent. The appellant by petition dated 30 April 2015 filed same day, sought that the election be nullified and a fresh election be ordered into the constituency.
