ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): This appeal was lodged against the Ruling of the Federal High Court, Lagos Division, Coram O.A. Faji, J. delivered on May 30, 2018, upholding a preliminary objection raised by the Respondents challenging the jurisdiction of the lower Court to hear the suit filed by the Appellant.

The facts leading to the appeal can be summarized as follows:

The Appellant, as a Ship Owner, Manager, Charterer and Agent, was approached by the 4th Respondent sometime in February, 2015, with a proposal to jointly hire/charter the 1st Respondent, MT NAMISA (now renamed MT VALOR (IMO NO. 8757790) for an agreed period. The Appellant reviewed the trading papers of the 1st Respondent and accepted to jointly hire/charter the 1st Respondent and to participate in the transaction to sub-hire/sub-charter the 1st Respondent vessel to prospective sub-charterers using the 3rd Respondent as the transaction/operation platform.
