MUHAMMAD, JCA (Delivering the Lead Judgment): This matter started as a criminal case at the Upper Area Court of the Federal Capital Territory, holden at Gwagwalada. The appellant herein was the complainant whereas the respondent was the accused. The complaint against the respondent was cheating contrary to section 320 of the Penal Code. The appellant was represented by one Muhammed Lawal Iyatawa who stated the appellant’s complaint against the respondent as follows: “I Mohammed Lawal Iyatawa, I am suing Mr. Silice Dan Jos because he is a mechanic who came to Code of Conduct Tribunal and we gave him one motor vehicle to repair. An engine was to be mounted to the motor vehicle and was agreed at N347,366.40. We paid including his profit. Now he has held over the motor vehicles and removed one of the engines and mounted it to his own vehicle. He had refused to repair our vehicles.
