JUDGMENT 

Plaintiff instituted this action on the 13/10/2014 for the refund to plaintiff the sum of GHC233,175.34 being the balance due on a friendly loan he  granted to the defendant at the agreed interest of 5% per month from  10/9/2010 to the date of final payment. 

THE CASE OF THE PLAINTIFF 

The Plaintiff, Col. Mike Ohene –Asante a retired Army officer now a farmer  claims that his friend Mr. Yaw Yiadom Boakye -Ansah a contractor  approached him sometime in the year 2002 for a friendly loan to carry out  his construction businesses. According to the plaintiff he sought a loan  from NDK Financial Service for an amount of GHC221, 000.00 for his  friend. The plaintiff stated that when the defendant his friend defaulted in 

the settlement of the loan NDK sued for the recovery of the loan and NDK  placed an embargo on plaintiff’s account and plaintiff was joined as 3rd defendant. Judgment was entered against 1st and 2nd defendants in the  sum of GHC663.857.649. According to the plaintiff, …
