Judgement

ADAMU JAURO, J.C.A. (Delivering the Leading Judgment): The appeal herein is against the judgment of the High Court of Justice, Plateau State in Suit No. PLD/J/254/2014 delivered on 21st January, 2014.

The plaintiff now appellant instituted the action against the respondent who was the Defendant before the trial Court and claimed the following reliefs:

"i. A Declaration that the land measured 0.19 hectares situate along main road, Daika village in Mangu Local Government Area of Plateau State belongs to the plaintiff, to the exclusion of any other person including the defendant.

ii. A Declaration that the defendant, having denied the plaintiff's title to the land in dispute, is liable to forfeit the structures raised by the defendants therein.

iii. An order that the Defendant has forfeited to the plaintiff the structures raised by him on the land.

iv. An order of injunction restraining the defendant, his servants, agents, assigns, and or privies from committing further acts of trespass on th…
