AGUBE JCA (Delivering the Lead Judgment): By an originating summons dated and filed on 18 June 2008, the appellant as claimant at the High Court of Justice of Kwara State in the Ilorin Judicial Division, sought for the following questions for determination and reliefs against the respondents (then defendants) as follows:

Whether the defendants who are the Executive Governor of Kwara State and the Chief Law Officer of the State , respectively, have the powers to dissolve the Kwara State Judicial Service Commission and thereby relieve the claimant of his appointment as a member, having regard to sections 197 and 199 of the Constitution of the Federal Republic of Nigeria, 1999. Whether the defendants are not bound by the provisions of the Constitution of the Federal Republic of Nigeria, 1999 in their decisions and/or actions.
