BA'ABA JCA (Delivering the Lead Judgment) This is an appeal against the judgment of the Zamfara State High Court, holden at Gusau Judicial Division, Gusau, Zamfara State presided over by Mika'ilu J, (as he then was), delivered on the 26th day of March, 2002. The respondents were the plaintiffs in the trial court where they commenced an action against the appellants who were the defendants, brought under the undefended list procedure, claiming against the appellants jointly and severally as per the endorsed writ of summons dated 24/1/02 as follows:- “The plaintiffs claim against the defendants jointly and severally are for the following: 1. “The sum of N2,087,435.00 (two million, eighty seven thousand, four hundred and thirty five naira only) being the cost of 83 bales of 15.695kg (exhibit A 272 MRR) cotton sold by the 1st plaintiff to the 1st defendant on the 24/3/2001.
