Judgement

JAMES SHEHU ABIRIYI, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment delivered on 9th November, 2016 in the High Court of Adamawa State holden at Yola. The Appellant as plaintiff claimed for several reliefs against the Respondent who was the defendant in the Court below. The Court below dismissed the claim of the Appellant and ordered him to return to the Respondent and exhaust all internal mechanisms for settling the dispute before approaching the Court.

The claim of the Appellant against the Respondent was for the following:

(i) A declaration that the Defendant is by the statute creating it obliged to award a degree to the Plaintiff who has pursued a course of study approved by it and satisfied such other requirements as it lay (sic) down.

(ii) A declaration that the Plaintiff having pursued and completed a course of study for the award of a B.Sc Degree in Business Administration and also satisfied all the requirements prescribed by the Defendant and mad…
