Judgement

JUDGMENT 

On the 23rd March 2015, Plaintiff caused the Writ of Summons to be filed against the Defendant. The reliefs endorsed on the Writ of Summons and repeated in the accompanying Statement of Claim were:

1. Declaration of title to the piece and parcel of land described in the  schedule 

2. Recovery of possession 

3. Perpetual injunction to restrain the Defendant by herself or by  her heirs, servants, agents, successors, assigns etc. or otherwise howsoever described from interfering with Plaintiff’s enjoyment  of his land 

4. General damages for trespass 

5. An order on the Defendant to remove whatever structure she has erected on the land at his own cost or in the alternative the  plaintiff to do it at the cost of the Defendant 

6. Any other order(s) the Court may deem fit. 

The description of the land in the schedule was stated as all that piece or  parcel of land situate, lying and being at Pantang-Accra and bounded on the  North-East by Proposed Road measuring 70.0 feet more or less…
