DECORBUILD GHANA LIMITED & SIAW NARTEY V. CAL BANK LIMITED

JUDGMENT

[1] The Plaintiffs commenced the instant action, Suit No. CM/BFS/0621/2021 against the Defendant on 26th May 2021. 

[2] Per the Writ of Summons and Statement of Claim, the Plaintiffs are seeking for the following reliefs:

a. A declaration that the amount of GHC26,347,835.64 being loan and interest amount payable as at February 22, 2015 by the 1st Plaintiff to the Defendant as commonly agreed by the parties therein which formed the basis of the terms of settlement filed on 12th June 2018 in Suit No. BFS/122/2015 entitled CAL BANK LIMITED VS DECORBUILD LIMITED & 2 ORS was a mistake.

b. An order that the terms of settlement filed on 12th June 2018 which culminated in the consent judgment dated 18th June 2018 in Suit No. BFS/122/2015 entitled CAL BANK LIMITED VS DECORBUILD LIMITED & 2 ORS and entered on the common mistake of the parties is declared void ab initio and set aside on grounds of mistake
