RULING

The ruling is in respect of a Motion on Notice for an Order to Strike Out the 4th and 5th Respondents filed by the Applicants/Applicants (hereinafter called “The Applicants”) against the Respondents/Respondents (hereinafter called “The Respondents”) dated 11th December 2024. The instant application is supported by a 12-paragraphed Affidavit.

The relevant paragraphs of the Affidavit as deposed to by Manasseh Nartey read as follows:

That by an Originating Notice of Motion (Originating Motion) dated 18th March, 2024, the Applicants commenced this action against the name Respondents.

That the 1st, 2nd and 3rd Respondents filed an affidavit in Opposition to the said Originating Motion on 13th May 2024 after having been served.

That the 4th and 5th Respondents were served by substituted service upon an order of the Honourable Court dated 1st July 2024 after several attempts at serving them personally had been unsuccessful.
