UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of the High Court of Lagos State Coram Judice: Coker, J., in Suit No. LD/1546/2004: MRS. ABIOLA DOHERTY v. ALHAJA AFUSAT YUSUF and ORS. delivered on 14th August, 2009. The Appellant as Claimant before the lower Court claimed the following reliefs:

a. A declaration that I am the rightful owner and the person entitled to a certificate of occupancy over the land approximately measuring 276688.809 square meters of three (3) plots of land situate, being and lying at Badore Village near Ajah in the Eti Osa Local Government Area of Lagos State and coloured RED in the survey plan No: LU/LA/048/L/84;

b. An order of perpetual injunction restraining the Defendants whether by themselves, their agents, privies or otherwise howsoever from interfering with my peaceful enjoyment and possession of the land;

c. N2,000,000 as general damages for acts of trespass and

d. Cost of the action
