AMINA ADAMU AUGIE, J.C.A. (Delivering the Leading Judgment): Sometime in March, 1991, the Respondent let out its Area Office building in Kaduna, to a Company, Tabi (Nigeria) Enterprises Ltd., for two years, then for another five years till February 1998. After discussions with the Company, then represented by one Bilkisu Kokwain (deceased), there was a further extension of two years from 1998, however, when the Company failed to pay for that period, the Respondent's Solicitors wrote a demand letter and served it with a Quit Notice. The Company failed to comply with the Quit Notice, and the Respondent initiated proceedings at the High Court, Kaduna, against the Company and the Appellant, who had taken over management of the property after the death of Bilkisu Kokwain, wherein it claimed under the Undefended List -

(a) The sum of N300,000.00 being accumulated arrears of rent owed by the Defendant from 1st March 1998 to 1st March 2001.
