JUDGMENT
BACKGROUND
[1] The Plaintiff/Judgment Creditor commenced an action against the Defendant on 10 October 2014.
[2] On 25 January 2023, the Court differently constituted entered judgment in favour of the Judgment Creditor against the Judgment Debtor for the recovery of the sum of Twenty-Eight Thousand, Nine Hundred and Eighty-Nine Ghana Cedis, Six Pesewas (GHC28,989.06).
[3] The Plaintiff/Judgment Creditor filed an Entry of Judgment and served same on the Judgment Debtor. Thereafter, the Plaintiff commenced the execution process and attached the commercial property of the Judgment Debtor/Defendant.
THE INSTANT ACTION
[4] The Claimant, Richard Asare (hereinafter called “the Plaintiff”) commence the instant action by filing a Notice of Claim at the Registry of this court on 17 July 2023.
