UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Leading Judgment): The action before the Federal High Court, Lagos Division in SUIT NO. FHC/L/CS/1219/2915: ANCHORAGE LEISURES LIMITED and ORS v. ECOBANK NIGERIA LIMITED is in respect of a banker/customer relationship. The details of the reliefs claimed are not necessary for the purposes of this appeal. Suffice it to state that the said action has spawned several appeals to this Court and the Apex Court against some interlocutory decisions of the trial Court.

In the course of the proceedings at the lower Court, the Appellant herein, who is the Defendant at the lower Court, apprehensive that it might not receive a fair and dispassionate dispensation of justice from the Presiding Judge at nisi prius wrote the Chief Judge of the Federal High Court, applying/requesting for the matter to be reassigned to another Judge as it no longer had confidence in the Presiding Judge.
